Tajdidun Nikah dalam Tradisi Madura Persepktif Fiqh Syafi’i (Studi Kasus di Desa Lantek Kecamatan Galis Kabupaten Bangkalan)

Abstract

Marriage is a contract or bond to justify sexual relations between a man and a woman in order to realize the happiness of family life filled with a sense of peace and love in a way that is approved by Allah SWT. Marriage or marriage is a general sunnatulloh and applies to all His creatures. In realizing the noble goals of marriage above, it is not easy because you will encounter many obstacles and obstacles. The fundamental question in the process of compiling this scientific work is what is the background to Tajdidun Nikah for the residents of Lantek Village and even the residents of Madura Island in general. And what are the legal consequences of Tajdidun Nikah from the perspective of Syafi'i Maadzhab Fiqh. The type of research used in this thesis is library research and field research. This research is descriptive analysis, namely research that describes objective results of conditions encountered in the field and analyzed according to Islamic law. The research results show that the Tajdidun Nikah was carried out because they felt that during their marriage many undesirable things happened, or when carrying out the aqad it was not in accordance with the Weton or calculations in the community's beliefs, and how the Syafi'i Madzhab ulama responded to these problems. From the description above, it can be concluded that Tajdidun Nikah, according to the views of Syafi'iyah scholars, still has differences of opinion, but the opinion is strong, repeating a marriage does not make the previous marriage invalid nor does it reduce the number of divorces.
